Cuda License Agreement

If the terms of distribution in this Agreement are not appropriate for your organization or questions related to this Contract, please contact NVIDIA at the nvidia-compute-license-questions@nvidia.com. Subject to the other conditions of this Agreement, you can use the SDK to develop and test applications published in open source Initiative (OSI). The SDK is allowed for you, in order to develop applications only for use in systems with NVIDIA-GPUs. The following CUDA Toolkit files can be distributed with license applications that you develop, including some variations of those files that have integrated the version number or the architecture of specific information into file names – as an example only for version 9.0 of Windows 64-bit software, the cudart64_90.dll file is distributable. The SDK can be bundled or distributed with you with third-party software authorized by an NVIDIA provider and/or open source software provided under an open source license. The use of software by third parties, the licensing conditions of a third party or, in the absence of third-party conditions, are subject to the terms of this Agreement. Copyright on third-party software belongs to copyright owners who are listed in the third party software or license. The following third-party components included in the SOFTWARE are granted to the licensee under the following conditions: The terms and conditions of this supplement govern your use of the SDK NVIDIA CUDA Toolkit under the terms of your license agreement (“Agreement”), as amended by this supplement. The basic terms that are used below, but are not defined, have the meaning assigned to them in the agreement. The CUDA Toolkit end-user license agreement applies to the NVIDIA CUDA toolkit, NVIDIA CUDA samples, NVIDIA Display Driver, nvidia Nsight Tools (Visual Studio Edition) and related documentation on CUDA APIs, programming models and development tools. If you don`t agree with the terms of the license, don`t download or use the software. You recognize and consent that it is your sole responsibility to obtain additional third-party licenses to manufacture, use, sell, import and sell your products or services, including microsoft, Thomson, Fraunhofer IIS, Sisvel S.p.A., MPEG-LA, and coding technologies. NVIDIA does not grant you patents or other necessary rights regarding audio and/or video encoders and set-top boxes under this Agreement.
